1. Introduction and Context The question of what “artificial intelligence” is can be divided into two parts: “What is the essence of artificial intelligence” and “What is intelligence”. The first question is relatively easy to resolve, but it points to the question of what can be built. The second question is much more difficult, raising questions about consciousness, identity, and the mind (including the unconscious mind), as well as the question of which components are involved in the only type of intelligence that is generally considered to fall within the scope of intelligence. The study of animals and artificial systems (not simple models) is beginning to be considered a research agenda in the area of intelligence. When conceptualizing artificial intelligence, it is assumed that interaction with the environment faces real needs such as relationships between similar individuals, disputes between different individuals, pursuit and escape; in addition to causal relationships at different levels of intuitive understanding (conscious or unconscious) in addition to specific symbolic exchanges. Talking about artificial intelligence in law is a good way to start correcting common misconceptions about the use of technology in services markets. For better understanding, a quick contextualization is necessary. Previous industrial revolutions mainly served to scale up the mass production of consumer goods. Innovations made industries more productive and efficient as human manual labour was replaced by machines. Steam machines first appeared, later those powered by petroleum derivatives and electrical energy. The Third Industrial Revolution brought us computing and automation, increasingly eliminating the role of the operator. Now, we live in the Fourth Industrial Revolution, which is the era of technologies such as artificial intelligence and machine learning. With human work becoming less and less relevant in industries, we have entered the post industrial era, with the services sector concentrating an increasingly larger portion of the world's workforce. And here comes one of the common misconceptions about artificial intelligence: that it is only applied to industrial production machines. The increasing sophistication of algorithms allows computers to also perform work that is not exclusively manual, such as research, reviews, etc. Does this mean that Artificial Intelligence will replace all types of work? This is the second main misconception about artificial intelligence. What happens is that human work will have to be, in the broadest sense, increasingly human. Including in Law. Lawyers, judges, prosecutors, and other professionals in the sector provide an essentially intellectual service. Artificial intelligence in Law has been proving that there are tasks that can be assumed and performed by computers. The quality level of technology using artificial intelligence has increased significantly in the last year, with chatbots capable of holding fluent conversations with humans, writing songs or articles, and generating computer code. Still, experts say that even the most advanced AI systems are no match for human writing capabilities: They lack a personal voice and style and often produce wrong, meaningless, or biased answers. In March 2023, a photo that went viral on the Internet showed Pope Francis parading down the street in an oversized white coat that looked like he had just come from a fashion show in Paris. The internet went crazy. Eventually, it was realized that the photo was fake and had been created using a Midjourney AI image generator after a tip from a Chicago resident. This is just an example of the increasingly complex types of products that artificial intelligence can produce. "I think we're in a time of a lot of questions, and some of them feel quite deep and existential, especially when it comes to how we think about creativity in an era where artificial intelligence is going to take center stage in a lot of fields," says John Palfrey, visiting professor at Harvard Law School, and president of the John D. and Catherine T. MacArthur Foundation. 2. What do the numbers and statistics tell us? According to data from the most recent “Future of Jobs” survey prepared by the World Economic Forum (WEF), by 2027 it is estimated that 69 million jobs will be created and 83 million eliminated, which will result in a net decrease of 2 % of current employment. Meaning that 14 million jobs will disappear in the next five years or so. Another recent study by Goldman Sachs, cited by the Financial Times, concludes that around 300 million jobs in the most developed countries could be at risk. According to the study, lawyers and administrative staff are among those most at risk of becoming redundant. In the United States alone, around two-thirds of workers will be exposed to some level of artificial intelligence. Many of these workers will see less than half of their workload automated and will likely continue to work, dedicating part of their time to more productive activities. The study estimates that this will happen to 63% of the North American workforce, but 7% of that workforce will be completely replaceable. The impact in Europe should be similar. Furthermore, the study adds that AI content creation systems like ChatGPT can trigger productivity gains that will ultimately increase global annual gross domestic product (GDP) by 7% within a decade. While some see the emergence of AI with enthusiasm and expectancy, others invoke fears and dangers that this new technology could bring to Humanity. In March, more than 1,000 technology experts concerned about AI's potential to cause harm to society signed an open letter calling for a temporary halt to future AI development. "Powerful AI systems should be developed only when we are confident that their effects will be positive and their risks will be manageable," the letter states. Just over a month later, a computer scientist known as the "Godfather of AI," Geoffrey Hinton, shook the technology world by quitting his job at Google, citing his concerns about the dangers of AI technology. "It's hard to see how you can prevent bad actors from using this technology for malicious purposes," Hinton told The New York Times. What is certain for now is that these technologies will bring drastic changes to the concept of how we view jobs and labour production in practically all professions in the world. 3. Two Opinions and Professional Perspectives Focusing on the world of Law, a characteristic of any type of revolution is that, while it is happening, it is difficult to recognize it as such. In order to obtain specialized and experienced opinions, I had the opportunity to talk to 2 professionals from the main professions in the World of Law: Law and Judiciary. As such, I had the opportunity to speak with Dr. Professor Pedro Caetano Nunes, professor at Nova School of Law, coordinator of the Master in Law and Management, offered in conjunction with Nova School of Business and Economics and partner in the area of Dispute Resolution of the PLMJ Law Firm. Although the odds are greater than changing judges, the fact is that when legal software emerged (in the 1980s) and even more basic tools, such as document editing programs, many professionals were afraid. According to Prosecutor Cristina Janeiro, “it is unquestionable that AI can help professionals in terms of jurisprudence research (for example), but I do not believe that they will completely replace these professionals”. Law is not just about cold and objective analyses of the law. Ethical issues must be observed and the subjectivity of each case must be interpreted. In the judicial area, researchers at the University of Chicago have developed AI technology that predicts crimes with 80-90% accuracy. How? An algorithm is used that works based on the crime history of a specific city. Therefore, the system analyses the type of crime, place of occurrence, date and time, etc. Based on the records, this type of AI then uses that knowledge to generate time series and predict where and when crimes occur most frequently. The negative impact in the criminal area can include deepfakes, driverless vehicles or drones used as weapons, or forms of cyberattacks, improper access to personal data, scams with manipulation of facial and voice movements, dissemination of false information for defamation or slander or even new forms of manipulation of the securities market. 5. More Questions than Answers In fact, there are many doubts, if in a judgment phase a fair solution can be reached by a machine, unlike human beings who are endowed with intuition, emotion and equity, which are elements that are very important in the decision-making process and to reach a fair decision. From my perspective, I don't believe that it will become a reality in the near future, it could help, but not replace. AI will allow lawyers to reduce the time spent analysing both evidence and studying the underlying law and will provide greater legal rigor when making decisions. A robot will not be able to replace a judge and hand down sentences based on algorithms, since the rule in criminal proceedings is that the evidence is freely assessed by the judge, in accordance with the rules of common experience and what he learns through hearing witnesses. However, law and justice cannot ignore the fact that AI can become one of its most important assistants or adjuncts, whether for organizing procedural documents, for processing the evidence in the process itself, or even for research into jurisprudence and doctrine, contributing to more agile processes and increasingly faster decisions. What is certain is that robots are starting to take their first steps autonomously. In February, the world's first robot lawyer made his court debut and defended his first client. This was the first case in which AI took the place of a Human Being in defending a case in court. The robot, created by startup DoNotPay, gave instructions to the defendant on the best way to argue against a speeding ticket. But how were the instructions given? Easy, the robot was present on a cell phone and sent warnings through a headset to the defendant, who agreed that he would only say what the AI told him. What we should keep in mind We easily conclude that as Artificial Intelligence contributes to the performance of the professions of law and judiciary, we are also able to carry out a logical-deductive exercise that here too there is an opportunity for Law and access to justice to cease to be seen and labelled by many as a privilege or elitist access. What is certain is that it would be easy to understand that we could use reasoning that a lawyer using technology and using artificial intelligence can be seen as an additional cost for the professional in question and that as such would lead to an increase in the price of fees. However, as we previously analysed, it is also expected that the time spent by the professional will be optimized to perform certain tasks that could be more time-consuming and as such they can save this time that they would otherwise end up spending and focus on more cases, and on other activities. That will allow them to make their activity even more profitable. As such, with the professional able to monetize their work, we apply one of the main economic laws to the specific case, which is the law of demand and supply. By increasing supply, demand will decrease as well as prices so that they are more competitive and appealing to customers. Naturally, justice should not be seen as a business, but rather as a fundamental right to which all Human Beings must be entitled and Artificial Intelligence appears to us as a tool that gives us the possibility of achieving this objective.

Era criança. Era inocente. Disseram-me que íamos visitar um lugar mágico, um lugar onde todas as crianças são felizes. Um lugar onde os desejos se concretizavam. Lembro me de ser pequena, muito pequenina. E curiosa, perguntei ao meu pai “e como é esse lugar magico?”. É lindo”, disse ele. “Um lugar com pequenas casinhas feitas de guloseimas e chocolates, onde podes tomar o melhor chocolate quente da tua vida”. “Mas pai, como assim é feito de guloseimas e chocolates?”. “Vá lá, eu mostro-te”. E naquelas fotografias de um Toshiba xxxx vi um sonho, vi um lugar onde sabia que ia ser feliz. Ansiei. Esperei. E lá cheguei. Curiosa, de ânimos ao alto, uma inocente criança rechonchuda que apenas ansiava ver as casinhas de chocolate. Olhei, toquei e quase chorei. As casinhas não eram de chocolate. As casinhas não eram de guloseimas. As casinhas… nada mais eram que estruturas de pedra e deceção, que roubavam a inocência das crianças. Fiquei triste. Fiquei desiludida. E jurei nunca mais sonhar com casinhas feitas de guloseimas e chocolates. Jurei nunca mais ser criança e acreditar nas mentiras que me contavam. O mundo tornou-se preto e branco nesse dia… Cresci, apercebi me que não há um sítio mágico, onde todos somos felizes. Crescer é isto, é apenas isto… tudo o que era fofo e doce, endurece e amargura! É verdade, cresci… mas também amadureci, e foi aí que ouvi… A voz que disse àquela criança inocente para ver o mundo como ele é, cheio de mentiras e deceções… calou-se! Ou, pelo menos, calei-a! Vivo então com a vozinha de criança, que grita a bons pulmões, que se eu quiser as casinhas são feitas de guloseimas e chocolates. Se eu acreditar o suficiente, se eu sonhar o suficiente, se algo em mim voltar a ser aquela criança inocente que imaginava como se juntavam e colavam guloseimas e chocolates para construir uma casinha, então esse lugar onde sou feliz existe! Sou criança, serei sempre criança, pelo menos do que me dizem ser “criança”. Provo o meu chocolate quente, rodeada pelos brilhos de natal e as harmonias que só nesta época unem os ouvintes, e sei que sou feliz, se ser feliz é acreditar em magia!
- Remendos.
Remendos. Este Natal queria oferecer-te cinco minutos da minha perceção de ti. Infelizmente, não o posso fazer. Tenho pensado em como dar-te algo semelhante, mas parece-me faltar sempre alguma coisa. É que a minha perceção de ti são remendos. Remendos de momentos, sensações, filmes e livros. Remendos unidos por uma fita de cetim rosinha. Encontro o primeiro entrave aqui, não é só uma fita de cetim rosinha, é uma fita de cetim da minha cor favorita e não sei se ias perceber que a escolhi, porque também és a minha pessoa favorita e porque és para mim, o mesmo que possuir mais uma decoração rosinha. Van Gogh disse a Gaby que mesmo que a sua pintura de umas flores não fosse tão bonita como as próprias flores, pelo menos a sua pintura não ia murchar e tinha uma maior chance de sobreviver. Sinto-me assim com o toque da tua mão na minha. Posso passar o resto da vida a tentar escrever algo que se assemelhe ao conforto e ao quente da tua mão, algo que demonstre a sensação de olho molhado, da lágrima feliz no canto do meu olho, quando o meu coração não aguenta mais guardar o amor que o teu toque lhe transmite, mas a verdade é que nunca vou conseguir. Houve toda uma linha de raciocínio. Pensei primeiro em como mesmo calados, sinto amor só pela forma como olhas para mim. Relembrei-me que talvez pudesse só sentir, que não tinha de tentar escrever a sensação, mas depois lembrei-me que uma vez jurei não deixar nada por dizer. Sem saberes da minha jura, tenho medo de que não percebas a importância de te tentar escrever. Importância semelhante à que tens para mim. Carta do António para a Inês Querida Inês, A conversa entre mim e a Sofia sobre ti foi simples. A Sofia informou-me que eras uma pessoa muito trabalhadora e empenhada, e ambos notámos que, das nossas poucas interações, parecias uma pessoa muito bondosa e pura. Assim, convidámos-te para formar lista connosco, e o resto é história. Ao fim de mais ou menos dois meses e meio de mandato, e alguns extra de trabalho, consigo afirmar que estávamos certos. Fora a tua clara competência, és das pessoas mais amáveis que tive o prazer de conhecer, e gostaria de te conhecer melhor. Temos de marcar um jantar de direção neste próximo ano! Portanto, aqui vão umas palavras do meu coração para o teu. Um semestre de mandato passou e ainda me sinto como quando recebi a tua mensagem a convidar-me para fazer parte da direção: honrada com a responsabilidade, entusiasmada por poder ser parte (ainda mais) ativa na vida deste núcleo, receosa de não estar à altura. Destes quase três meses extraio a seguinte conclusão: tem sido um gosto tremendo trabalhar ao teu lado, e ver o empenho que depositas em cada coisa que fazes, por mais pequena que ela seja. Queres saber uma coisa engraçada que nunca te disse? Recordo-me perfeitamente dos primeiros textos teus que li no Jur.nal. Um que me ficou particularmente marcado foi o “Fundo da piscina”- Lembro-me de o ler e ficar tão impressionada com a qualidade da escrita. Pensava para mim “como é que alguém da nossa idade escreve tão bem”. Mais tarde, tive a oportunidade de te conhecer melhor, e pude constatar, com alegria, que à talentosa escritora (acho que a designação é mais que merecida) corresponde uma pessoa de coração bom, com um sentido de justiça apurado e vontade de mudança a correr-lhe nas veias. Sei, e espero que o resto do Jur.nal também o saiba, a sorte que tem em ter-te como sua diretora. Sofia, o país está um caos, o mundo está um caos. O Natal já não sabe da mesma forma do que quando era pequenina. O inverno é doloroso. Parece uma frase feita, mas acho que só a arte e os afetos nos vão salvando (ou pelo menos, é o que nos dá algum alento). Numa nota final, quero agradecer-te por teres proporcionado que algo tão especial tenha acontecido no meu 2023! Fiquei muito feliz quando me calhaste no carteiro secreto da Direção, porque agora tenho a oportunidade perfeita para o fazer. A tua madrinha anda sem muita inspiração nesta semana, não sei se é do frio, da matéria de penal, da confusão emocional interna, do acne na minha cara... Não sei, mas vou chamar as ninfas da imaginação para me ajudarem, porque mereces algo bonito. O Saramago dizia que odiava o Natal, acho que ambos sabemos que é por causa de ser uma data que a Igreja Católica instrumentalizou para a produção de riqueza própria, fazendo uma propaganda mesquinha de ‘ajuda aos pobres’. O Capitalismo, primo da Igreja Católica, também ama o Pai Natal e aproveita para olear a sua máquina. O Saramago odiava o Natal, por um lado, porque os praticantes do bom catolicismo (amen) decidem gritar aos céus que querem erradicar a pobreza, esquecendo-se que precisam de pobres para continuar a sua bendita doutrina. Por outro lado, penso que o seu ódio pela data é originado pelo facto do Natal trazer consigo uma carga emocional muito forte, está intrinsecamente ligado a família, instituição esta também bastante problemática, e à obrigação da realização de atos de amor em dois dias específicos do ano, porque supostamente o “salvador” nasceu. Kiko, acho que o Natal é como a Barbie para mim, sabes? Reconheço os seus problemas, sei que a Barbie representa um conceito de mulher utópico, quer exteriormente, quer interiormente, que incentiva as mulheres a caírem no buraco de uma indústria “feminina” consumista, criada especificamente para alimentar as nossas inseguranças, mas, apesar disto tudo, seria desonesto da minha parte dizer que o meu coração não parte aos bocadinhos ao lembrar-me da quantidade de barbies (algumas destruídas completamente) que tenho numa caixa no sótão. A nostalgia é demasiada para não lhes sentir carinho. Sinto o mesmo em relação ao Natal. Poderíamos argumentar que eu não tenho saudades da Barbie nem do Natal especificamente, mas sim da Sofia pequenina que os adorava, mas talvez as duas coisas possam ser verdade. Agora, o mundo já não me parece cheio de efeitos vermelhos e dourados, as luzes já não piscam de forma tão brilhante, já não recebo casas da Barbie no Natal, mas aprendi a gostar dos doces de Natal. Apesar do Natal me ser mais cinzento, eu adoro qualquer oportunidade que me faça parar e pensar no quanto gosto das pessoas que partilham um existir comigo e, claro, tu és uma delas. Acho que me apercebi que te adorava depois de ler o poema que enviaste para a Edição Física do ano passado. Claro que eu gosto do Kiko profissional, que tem mil e quinhentos contactos, que faz mil coisas ao mesmo tempo, mas o meu Kiko preferido é o que me vem dar um beijinho e um abracinho todos os dias, que, quando me vê, corre logo para mim, que tem caracóis que formam um coração na testa e que vomita para o papel sentimentos puros e complexos. Gosto muito mais da forma como amas, do que da forma como és uma máquina laboral. Gosto muito muito de ti, espero que esta carta te chegue bem, que estejas muitooo feliz neste Natal, nem que seja só por causa dos docinhos. Sofia.
- NADAR CONTRA A MARÉ
Há dias, naquilo que pensei que seria apenas uma aula como tantas outras, falaram-me da “luta contra a corrente”. Disseram-me que se temos um sonho ou uma missão, especialmente enquanto juristas atentos aos nossos surroundings , teremos muitas vezes de lutar contra a corrente (ou como eu tomei a liberdade de “traduzir”: de nadar contra a maré); com tudo o que isso possa acarretar para nós (“dói para caraças”, creio que foi assim)… A decisão de entrar num barco, pegar num remo (às vezes tem mesmo de ser num pedaço de madeira improvisado) e começar a remar contra a maré que nos empurra na direção oposta, nunca é fácil, nem tão-pouco poderia ser. Fácil é nadarmos a favor da maré, e ainda mais fácil é deitarmo-nos numa bóia e deixarmo-nos ser levados pela corrente (mesmo que de vez em quando vamos barafustando sobre qualquer coisinha, porque logo voltamos a adormecer em cima da bóia de novo). E ficar deitado na bóia é tão fácil… não há crítica nem chatice que nos chegue, não há angústias (as que há são meramente passageiras), não é sequer preciso um esforço minimamente ativo para nadar. O problema é que às vezes estamos a flutuar há tanto tempo, deitados naquela boia que vai a favor da corrente, que ela rebenta. Um dia a bóia rebenta, e nós já nos esquecemos de como nadar. Afogamo-nos. Pois é, se calhar é importante aprendermos a nadar contra a maré… Porque mesmo se um dia o mar ficar demasiado agitado, nós saberemos que temos a força e a coragem de continuar a nadar, apesar de todo o esforço. E, mais importante que isso no mundo de hoje, ficamos imunes àqueles que tentam ir soprando para nos desviar do nosso caminho; porque uma bóia é fácil de desviar com uns quantos sopros, mas alguém que vai a nadar sozinho contra a maré, dificilmente é desviado por um sopro. Num apelo mais pessoal: tenham mais empatia, tenham mais respeito, tenham mais seriedade. Eu sei que é fácil nadar a favor da maré, sei que é ainda mais fácil ficar deitado em cima da bóia, sei até que não é assim tão difícil ser um dos sopros que vai empurrando os que estão na bóia para onde queremos… Nós estamos TODOS sempre a tempo de aprender… Mas temos primeiramente de ter vontade de o fazer, e temos de ser sérios e empáticos nesse processo. O meu desejo mais sincero é que, num mundo de cada vez mais desinformação e sensacionalismo, possamos ser sempre (especialmente nós, estudantes de Direito), aqueles que lutam contra essa corrente, sem medos e mesmo quando nos seja custoso a nível pessoal (porque a mudança custa sempre, e se não custar há algo que estamos a fazer mal)… Mudar o mundo está nas (não tão) pequenas coisas, naquelas que são impulsionadas pelos nossos princípios morais e pelo nosso dever de ação, pois acreditar na possibilidade de um mundo melhor é estar sempre na primeira linha, pronto a lutar com todas as nossas forças por aquilo que sabemos estar correto. Eu cá estarei sempre disposta a ir tentando mudar o mundo aos poucos, mesmo quando ele ainda não estiver disposto a ser mudado. Não só porque tenho de manter a esperança que um dia os outros também estarão abertos a essa mudança, mas principalmente porque sei que desta forma terei sempre a certeza de ter feito o que podia por aquilo em que acredito, e o que os meus valores ditaram. Mesmo (especialmente) quando isso signifique ter de nadar contra a maré…
- Solipsismo
De tempos em tempos surgem momentos de crise, que mostram o alcance, os limites e novas imagens sobre as pessoas; os problemas que culminam nesses conflitos frequentemente já se encontravam presentes há eras, de maneira sutil, guiando os nossos comportamentos até a iminência do seu estouro, tornando-se nítidos e fomentadores dos vícios em todas as partes. Para mim, em momentos como nós estamos, revela-se novamente um enorme defeito: a vaidade. A realidade é que nós, estudantes de Direito, somos nada. Apesar da noção comum de que somos os virtuosos defensores da justiça e da verdade, nada nos garante essa posição e título. Não passamos de pessoas que passam 4 anos aprendendo como interpretar normas de conhecimento público, criadas há mais de 40 anos; a maior parte de nós não tem um feito próprio que comprove e fundamente a sua moralidade e consciência superiores. Não detemos legitimidade para impor nosso discernimento, sobrepor nossas visões e nos colocarmos antes dos demais. E é a partir do momento que nos valorizamos a um ponto de sermos inquestionáveis e encontrarmos absurdos nas menores diferenças, é quando nos limitamos e vive-se uma fantasia. O ceticismo é o primeiro passo de um pensamento científico e para a busca da verdade, e é ao assumirmos factos e não duvidarmos, que se encontra a ignorância. Viver em plena ignorância é encontrar-se limitado por não sequer perceber o seu próprio limite, é viver uma ilusão ao nunca se colocar em pé de igualdade; uma vez que se está tão absorto nas próprias ideias. Nesses casos, estamos sempre estagnados, nunca se contesta, nunca se sai da zona de conforto, nunca se aprende a aprender. Muitos vêm para a faculdade com a intenção de melhorar o mundo, mas não conseguem melhorar nem eles mesmos; querem ajudar os outros, mas não conseguem parar de falar antes de ouvir. Com isso, corroboram para um sistema que eles mesmos lutam e criticam. Procura-se corrigir no mundo exterior e em terceiros e frequentemente passa-se despercebido as próprias hipocrisias, contradições e falhas; de modo que no caso de discordâncias, as pessoas são ou condescendentes consigo mesmas ou são reativas ao externo. É a partir da humildade que se adquire uma visão mais real, em que se percebe a verdade, a ambiguidade e a contradição sobre si mesmo e o mundo; tornando possível a apreensão de diferentes lados e visões. É necessário reduzir e despir-se das nossas camadas mais superficiais e luxuosas, como certezas, ego, sentimentos e hábitos, que protegem o Solipsismo em cada um de nós, e nos separam do mundo. Apenas quando enxergar a si mesmo com clareza é que se será capaz de se reconhecer no outro lado, mesmo que parcialmente. Com isso, percebe-se a multilateralidade sobre a verdade e a indefinição da mesma, percebe-se a contradição em tudo e o paradoxo do que é certo e errado; por fim, percebe-se que você sabe que nada sabe e nunca existe outra resposta além de procurar sempre uma resposta.

- Pequenas coisas
Sinto tudo e nada ao mesmo tempo. É como se me encontrasse num limbo estranho entre a realidade das minhas emoções e aquilo que consigo exteriorizar. É como se tudo o que sinto estivesse num poço, fundo, escuro, quase interminável. Mas e quando transbordar? O que acontece depois? É difícil equilibrar-me nesta corda bamba em que me encontro. Às vezes, de noite quando ninguém me vê ou ouve, sinto que um mero sopro me podia deitar abaixo, mas, mesmo assim, as lágrimas não me escorrem pela cara, não me sinto a soluçar com a força de tudo o que sinto, simplesmente existo a ponderar sobre tudo. Quando o sol se levanta, e eu com ele, gosto de fingir que não aconteceu nada, que nunca estive perto de cair no abismo que está debaixo de mim. É um novo dia por isso tudo pode mudar, certo? Com ele vêem novas oportunidades, novos desafios, novos obstáculos, mas enquanto é dia eu tenho que me equilibrar. Durante o dia eu não sinto, mas dou a atuação da minha vida. Durante o dia, minto a mim mesma e digo que estou só cansada, nada mais. Mas no fundo sei que não é verdade. Mas então o que é? A realidade é que nem eu sei, mas sei que não é cansaço. É algo mais sombrio e pesado, algo que conseguiu criar raízes em mim de tal maneira que já não sei viver sem a sua sombra a acompanhar-me diariamente. Então, vivo neste limbo, nesta corda bamba de sanidade mental, na qual uns dias parece impossível aguentar-me em pé e noutros ando com a confiança de alguém que está a caminhar em solo firme. Olho em volta, e a escuridão que se instalou em meu redor faz-me crer que estou sozinha, sem apoio, sem ninguém a andar na mesma corda que eu. Mas se me esforçar, se esquecer esta névoa que me obstrui a visão, parece que vejo silhuetas, silhuetas do que parecem ser mais pessoas a andar nas suas cordas. Começo a duvidar se estou mesmo só, se só eu é que passo por esta interminável luta diária. Às vezes chego à conclusão que sim. Estou simplesmente só nesta luta e não posso convidar ninguém para caminhar comigo pois se cair, não quero cair com companhia. Esses são os dias piores, aqueles dias que tudo parece uma tarefa infindável, tudo me irrita, tudo corre mal, são os dias em que a minha cabeça parece estar debaixo de uma núvem negra e densa que não me deixa ver mais nada à frente. Mas depois há dias em que cada pequena coisa parece um raio de sol que penetra a escuridão em que me encontro. Uma mensagem de bom dia de um amigo, uma conversa parva que me faz rir até que me doa a barriga e as pessoas à minha volta pensem que sou maluca (e se calhar até sou), um abraço de alguém que me apoia em tudo, um elogio que para aquela pessoa pode não ser nada mas para mim é tudo. São as pequenas coisas. Aquelas coisas que se transformam em raios de sol e que levantam a névoa da solidão em que estou para conseguir olhar em redor com clareza. Porque, afinal, não estou sozinha. Mais pessoas caminham na minha corda e outras estão à minha volta a tentar equilibrar-se no seu próprio limbo. Apercebo-me tão repentinamente desta realidade que a sua força traz ao de cima todos os sentimentos que estiveram durante tanto tempo presos dentro de mim. Todas as lágrimas que não caíram, todos os soluços que encarcerei com medo que me desequilibrassem e me fizessem cair. São as pequenas coisas que me apoiam quando estou quase a cair. São as pequenas coisas que me guiam quando perco o caminho. São as pequenas coisas que fazem dissipar a núvem que pensava carregar eternamente. São as pequenas coisas que me fazem sorrir. E por isso, retribuo e faço estas pequenas coisas. Estas ações "insignificantes" que significam tanto para alguém. Eu gosto de pequenas coisas, pois estas fazem-me continuar.
- Pedido de Fiscalização ao Conselho Fiscal
Caros colegas A transparência e fundamentação de decisões é fundamental para o funcionamento de qualquer instituição que se mova por princípios democráticos. O mesmo é verdade sobre a discussão em espaço público sobre as instituições. Submeti o meu Pedido de Fiscalização, que podem encontrar aqui no Jur.nal, porque sou da opinião de que deve haver esclarecimentos sobre todas as questões presentes no Edital nº7/2023. Reuniões e decisões de órgãos da AE devem ser discutidos e escrutinados por todos. Cabe-nos a nós estudantes pedir mais das nossas instituições. Convido toda a comunidade a ler e discutir o meu pedido de fiscalização. Faço questão que se pronunciem sobre esta questão no Jur.nal ou noutros meios igualmente acessíveis à comunidade, porque só assim há discussão construtiva sobre matérias que nos afetam a todos nós. Todos ganhamos imenso com isso. Um abraço e boas festas, bebam e comam muito, estudem quando der jeito. Caros membros do Conselho Fiscal, Escrevo ao abrigo do Artigo 43º, nº1, alínea c) dos Estatutos da NOVA School of Law Students’ Union (doravante, “Estatutos”) enquanto legítimo interessado por ser eleitor e ter participado no ato eleitoral do passado dia 4 de dezembro, para pedir a fiscalização, conforme os Estatutos e a Lei, dos atos expostos a seguir. Este pedido de fiscalização sai no seguimento da publicação do Edital Nº7/2023 da Comissão Eleitoral (doravante, Edital e CE respectivamente), que determinou a convocatória de novas eleições. Este Edital foi infeliz na sua formulação, uma vez que estatui uma consequência bastante grave sem explicar devidamente as razões, processos, e lógicas exatas de cada ponto apresentado para tal. Falhando ainda na resposta a várias questões colocadas na Impugnação que visava responder. É fundamental para a garantia do princípio da democraticidade, previsto no artigo 2º dos estatutos, que sejam claras e coerentes com a lei e os estatutos as razões que levaram à convocação de novas eleições. É direito de todos os membros que seja o mais transparente possível os motivos pelo qual se puseram em causa os votos de 275 eleitores. Assim sendo, peço a fiscalização conforme os estatutos e a Lei dos seguintes atos: 1. A decisão tomada pela CE na reunião de dia 7 de dezembro de 2023 de convocar novas eleições, conforme o princípio da democraticidade previsto no artigo nº2 dos Estatutos, o principio da proporcionalidade consagrado no nº7 do Código do Procedimento Administrativo (cujo âmbito de aplicação engloba a Associação de Estudantes nos termos do Artigo nº2 do mesmo), e o princípio da igualdade (reinvidicado pela própria CE no edital) nos termos do artigo 13º da Constituição da República Portuguesa. De forma mais especifica, peço ao Conselho Fiscal para fiscalizar ainda qual a base de deliberação nesse sentido, uma vez que a Impugnação do ato eleitoral apresentada por Carolina Correia e Isabel Costa pedia apenas (e cito) “a) A identificação pela Comissão Eleitoral de todas as solicitações de voto em mobilidade apresentadas pelos estudantes à Mesa da Assembleia Geral, bem como identificação do nº. Total de votos neste regime; b) Sem prejuízo e, caso se verifique que as situações apresentadas para o execício do voto em mobilidade não sejam justificadas nos termos dos Estatutos, sejam os mesmos considerados enquanto votos nulos” 2. Não publicação dos cadernos eleitorais por parte da CE, nos termos do artigo 56º, alínea b) dos estatutos e o princípio da legalidade nos termos do Artigo 3º do Código do Procedimento Administrativo. Uma vez que o edital nº7/2023 simplesmente diz que “permitem identificar os alunos constantes no mesmo” (o objetivo dos cadernos eleitorais?) e diz ser “compreensível” a sua não publicação, não elaborando a lógica ou sequer citando qualquer base legal. 3. Critérios de aceitação de votos em mobilidade por situação análoga, conforme o previsto no 67º, nº7 dos estatutos, o modo em específico como foram aceites, e as razões para recusa de um dos votos. O edital limita-se a dizer permitiu “implicitamente” dois pedidos por “considerar legítimos”, e que mais tarde aceitou (e recusou) mais pedidos sem “método estabelecido para tal” na base da “precedência” que estes dois primeiros votos aceites deixaram. Ora, se houve critérios para aceitação dos dois primeiros votos, que depois levaram a que se aceitassem votos mais à frente, então fica contraditório a noção de que não havia “método pré estabelecidos”. Isto até porque, aparentemente, foi recusado um desses pedidos, o que implica que houve critério para determinar a exclusão desse voto. Esses critérios devem ser clarificados para todos os membros da Associação de Estudantes. 4. O método de votação e processo de escrutínio dos votos em mobilidade e se este não põe em causa o anonimato, seja direta ou indiretamente através da possibilidade de determinar a localização (IP) do votante, e sentido de voto do eleitores, conforme o indicado no Artigo 63º, nº1 dos estatutos. Nem a CE nem a Mesa da Assembleia Geral anunciaram, antes do ato eleitoral ou através do Edital, qual a interface utilizada para recolha dos votos, os termos em que funciona, e de que formas garantem que os links são só acedidos pelos eleitores a que se destinam. Mais do que perceber se as eleições que vão ocorrer são de acordo com a lei e com os estatutos, é importante perceber a lógica e os argumentos que justificam estas decisões, que não foram expostos nos editais emitidos. Ignorar a expressão eleitoral de 275 votantes sem procurar sequer sanear possíveis vicissitudes (que era, aliás o pedido na Impugnação apresentada) é um ato que requer fundamentação extensa que deve ser disponibilizada para alvo de escrutínio de todos os estudantes. Sublinho a importância de fiscalizar os critérios para aceitação de votos em casos análogos à mobilidade, para que nas próximas eleições agendadas para dia 15 de dezembro sejam claros para todos os critérios de validade de votos.
